These Terms of Use (“Terms”) form a legal agreement between you and Guangzhou Qian-Mo Interactive Technology Co., Ltd (“Company”, “we”, “us”) regarding your download, access, and use of the mobile game Eternal Cultivator (the “App”) and related services.

By installing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. About the Service

Eternal Cultivator is an entertainment mobile game. Features may include account login via Sign in with Apple (the only login method), gameplay progression, virtual items, Apple In-App Purchases, push notifications, and customer support. Features may change over time.

2. Eligibility

You must meet the minimum age required in your jurisdiction to use the App and to make purchases.
If you are a minor, you must have parental/guardian consent where required.
You represent that you have legal capacity to accept these Terms.

3. Account Registration & Security

You sign in only with Sign in with Apple. We do not provide guest login or other third-party login methods.
Your Apple ID and Apple’s authentication services are governed by Apple’s terms; we receive only the identifiers/information Apple shares with the App for login.
You are responsible for maintaining the confidentiality of your Apple ID, device, and in-game account.
You agree not to impersonate others or misuse another person’s Apple ID.
Notify us promptly of unauthorized use at qianmohdgz@163.com.
We may suspend or terminate accounts for violations, fraud, or security risks.

4. License to Use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for personal, non-commercial entertainment.

You may not:

Copy, modify, reverse engineer, decompile, or create derivative works of the App, except where mandatory law allows
Rent, sell, sublicense, or commercially exploit the App without our written permission
Bypass security, access non-public interfaces, or interfere with servers
Use cheats, bots, malware, exploits, or unauthorized third-party tools
Upload illegal, infringing, or harmful content

5. Virtual Items & In-App Purchases

The App may offer virtual currency, items, privileges, or other digital content (“Virtual Items”).
Virtual Items are licensed, not sold, and have no real-world cash value outside the App unless required by mandatory law.
Purchases are processed by Apple In-App Purchase. Apple’s terms and billing rules apply.
Except where required by Apple’s refund policies or applicable law, fees are non-refundable after successful delivery of Virtual Items.
We may adjust prices, availability, or attributes of Virtual Items reasonably for operations and balancing.
If you use Family Sharing / Ask to Buy features, follow Apple’s rules.

6. Subscriptions (If Applicable)

If the App offers auto-renewable subscriptions:

Payment is charged to your Apple ID account at confirmation of purchase
Subscription renews automatically unless canceled at least 24 hours before the end of the current period
Manage or cancel in iOS Settings → Apple ID → Subscriptions
Any unused free trial portion may be forfeited when you purchase a subscription, where allowed by Apple rules

If no subscription products are offered, this section does not create any subscription.

7. User Conduct

You agree not to:

Harass, abuse, or harm other players or staff
Engage in fraud, money laundering, or chargeback abuse
Trade accounts or Virtual Items in unauthorized markets
Spread viruses, spam, or illegal content
Violate any applicable laws or third-party rights

8. User Content

If you submit nicknames, chat/messages, images, feedback, or other content (“User Content”), you retain ownership of your User Content, but grant us a worldwide, royalty-free license to use, host, reproduce, and display it as needed to operate and improve the App. You represent that you have rights to the User Content you submit and that it does not violate law or third-party rights. We may remove content that violates these Terms.

9. Intellectual Property

All rights in the App, including software, artwork, audio, text, trademarks, and game design, are owned by the Company or its licensors. Except for the limited license above, no rights are granted to you.

10. Third-Party Services

The App may integrate third-party services (e.g., Apple services, analytics/attribution SDKs, Unity components). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OR, IF GREATER, THE MINIMUM AMOUNT REQUIRED BY MANDATORY LAW).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Indemnity

You agree to indemnify and hold harmless the Company and its affiliates, officers, and employees from claims arising out of your misuse of the App, your User Content, or your violation of these Terms or applicable law.

14. Suspension & Termination

We may suspend or terminate access if you violate these Terms, create risk/harm, or if we discontinue the App. You may stop using the App at any time. Upon termination, your license ends. Provisions that by nature should survive will survive termination.

15. Changes to the App and Terms

We may update the App and these Terms from time to time. Continued use after updates become effective constitutes acceptance where permitted by law. If you do not agree, stop using the App.

16. Governing Law & Disputes

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your residence require otherwise. Disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to a competent court in Guangzhou, Guangdong, China, unless mandatory law requires another venue.

17. Apple-Specific Terms (iOS)

These Terms are between you and the Company, not Apple.
Apple has no obligation to provide maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any) to the maximum extent permitted; Apple has no other warranty obligation.
Apple is not responsible for addressing claims relating to the App, including product liability, legal compliance, or consumer protection claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
